DuPage County law firm Momkus LLC is pleased to announce a recent Appellate decision obtained by commercial litigation attorney Lauryn Parks regarding the case C. Szabo Contracting, Inc. v. Lorig Construction Company, 2014 IL App (2d) 131328. The Illinois Second District Appellate Court affirmed the trial court’s judgment in the amount of $215,400 in favor of the sub-subcontractor and against the general contractor under a theory of equitable relief. The trial court entered its judgment in favor of the sub-subcontractor following a two-day bench trial, and the matter was successfully briefed and argued on appeal by Momkus LLC Associate Attorney, Lauryn Parks.

The lawsuit arose from work that the sub-subcontractor performed on a multi-million dollar contract for the Illinois State Toll Highway Authority. After the sub-subcontractor completed its work on the project, the general contractor failed to pay either the subcontractor or sub-subcontractor for this work.

After the sub-subcontractor failed to file a timely mechanic’s lien, it retained Momkus LLC to pursue payment from the general contractor under an equitable theory of unjust enrichment. After the trial court entered judgment in the sub-subcontractor’s favor for the full amount sought, the general contractor appealed the ruling to the Second District Appellate Court. After entertaining oral argument on the matter, the Second District affirmed the trial court’s ruling in an opinion that substantially expanded the doctrine of unjust enrichment. The court held that the general contractor’s retention of the benefit of the sub-subcontractor’s work, without paying anyone for it, constituted unjust enrichment, and that the sub-subcontractor should be fully compensated for its work.

James McCluskey is pleased to announce his candidacy for the position of 2015 Third Vice President of the Illinois State Bar Association (ISBA).

Jim is a founding partner at Momkus LLC located in Lisle, IL. Jim has practiced commercial litigation for over 35 years, and has successfully represented clients throughout the Chicago area including Cook County, DuPage County and Kane County. During the course of his legal career, Jim has tried more than 55 civil jury trials to verdict, in state courts throughout Illinois, and in federal courts in northern and central Illinois.

Jim is a long-time resident of Batavia, and has been married to Jeanne McCluskey for 30 years. They have two adult daughters, Jaimie and Jessica.

Jim earned his Bachelor of Science Degree in Accounting from Elmhurst College in 1976, Juris Doctorate Degree from Northern Illinois University College of Law in 1979, and a Master of Laws in Taxation from The John Marshall Law School in 1988.

Jim was recently appointed to the Illinois Supreme Court Committee on Professional Responsibility. He currently serves as a member on the Illinois State Bar Foundation, and is the acting Chair of the ISBA Task Force on the Effect of Law School Debt on the Profession. He is also a Chair of the Facilities and Technology Committee of the ISBA. He is a member of the ISBA Budget & Audit Committee and Investment Committee. He has also held several prominent leadership roles for the DuPage County Bar Association, including the positions of President, General Counsel and Assistant Treasurer.

DuPage business litigation lawyer Jennifer L. Friedland has worked as an Associate Attorney with Momkus LLC for nearly eight years. She graduated from Tulane University Law School in 2006 and earned an Environmental Law Certificate and was awarded the Community Service Award for Commitment to Public Service. She obtained her undergraduate degree, magna cum laude, from the University of Kentucky.

Friedland focuses her legal practice in commercial and business litigation, civil litigation and appellate law. Most recently, she has achieved success at the trial and appellate court levels in a breach of contract case wherein she defended a manufacturer of parts to be used by the United States Army in mine-resistant ambush protected vehicles. Friedland also prevailed in an appeal of a summary judgment order entered pursuant to the Illinois Trade Secrets Act. She has also presented oral arguments before the Seventh Circuit Court of Appeals and the Illinois Second District Appellate Court.
